Teletask Inc. (licensor)
agrees to allow its customer (licensee) to operate Click ‘N Learn software on a
single machine/server. This can apply to a machine/server on licensee premises
or on a machine supplied by a third party hosting service. In addition, Click ‘N Learn WIC
participant usage is limited to those in The Utah County WIC Program. Use of this Click ‘N Learn software for
any other purpose or on any other machine is strictly prohibited and will be
considered a violation of this agreement and applicable United States Copyright
Law, unless specific permission in writing is given by the licensor. Teletask, Inc. reserves the right to use
all legal remedies under all state and federal laws, including United States
Copyright law, to enforce the terms of this license and seek damages and/or an
injunction against any person or entity’s unauthorized use of Click ‘N Learn
software.
In order for Click ‘N Learn to run, Teletask
uses three software programs that are GPL (General Public License)
programs. More information on the

This agreement shall be binding on the parties’
successors, heirs and/or assigns.
The laws of the State of California shall govern this agreement, without
regard to conflict of law provisions, and the exclusive venue for any action
related to this Assignment shall lie in Sacramento County, California. In the event of a dispute arising out of
this agreement, the prevailing party shall be entitled to recover from the
non-prevailing party, the prevailing party’s reasonable attorney fees and costs
incurred at trial and all appellate levels, with the definition of “costs” to
include expert witness fees, filing fees incurred, and other costs awarded to
the prevailing party as provided by law.
Installation of the Click ‘N Learn software on a single
machine constitutes acceptance of these licensing terms.
